Danny Masterson told a judge on Monday that he will not testify in his own defense as his rape trial nears its conclusion.

Between 2001 and 2003, Masterson, a former “That ’70s Show” star, is accused of raping three women.

Judge Charline Olmedo asked Masterson if he had a chance to discuss his decision with his attorneys. She replied that he had and asked him what his decision was.

“To testify,” said Masterson.

Prosecutors formally rested their case Monday morning, and defense attorney Philip Cohen also rested on the pretext that he would not call any witnesses. Closing arguments are set for Tuesday.

Cohen filed a motion to dismiss the lawsuit, but it was denied.

The three women have previously taken the stand on the issue, often giving emotional testimony about the assaults they suffered. A fourth woman testified in support, telling jurors that Masterson raped her in 1996.

The three plaintiffs were all members of the Church of Scientology at the time of the attack. Masterson is still a member of the church. Two of the three accused said the church had discouraged them from coming forward, and all three were threatened and harassed after they went to the police in late 2016.

While one of the women waited 14 months before going to the police, two waited more than 13 years.

Cohen tried to uncover discrepancies in the accounts the women gave during the investigation. Cohen also tried to minimize discussion of the church and its practices, and argued that the church should not be mentioned before the hearing.
